1. Purposes of this Agreement
This KROSS KOMICS Terms of Use (the "Agreement") is an agreement between you ("User" or "Users") and "We", ”Our” or "KROSS KOMICS ").
KROSS KOMICS Services ("KROSS KOMICS," "Service" or "Services") are provided by KROSS COMICS Inc. ("We," "Our" or "KROSS KOMICS") to you ("User" or "Users").

  
2. Definition
“Digital Content” shall mean digitized comic books and cartoons also known as webtoons or online comics, and related digital services provided hereunder.
“KROSS KOMICS Website” shall mean www.krosskomics.com.
“KROSS KOMICS App” shall mean KROSS KOMICS’s application through which you can access, use, and manage our Digital Content or other services on one or more electronic devices (e.g, smartphones, tablets, iPhone, iPad, PC/Mac, et al.).
“Cash” or “Coin” is referred as Pts. in KROSS KOMICS, which are purchased and used by End Users for the Website and App.

  
3. Limited License Term and rights
The Content on the Service, and the trademarks, service marks and logos ("Marks") on the Service, are owned by or licensed to KROSS KOMICS, subject to copyright and other intellectual property rights under the law.

You understand and agree that KROSS KOMICS Website, KROSS KOMICS App and/or Digital Content, software, visual interfaces, interactive elements, features, information, graphics, design, compilation, computer code, products, look and feel, and all other elements of the Service, are protected by the laws of the Republic of India relating to the protection of intellectual property and proprietary rights, including copyright, patent, trade dress, and trademark laws, as well as laws relating to data protection and security. All Digital Content and the Service, including intellectual property rights herein and thereto, are the property of KROSS KOMICS or its subsidiaries or affiliated companies and/or third-party licensors.

You shall not download any Content unless you see a "download" or similar link displayed by KROSS KOMICS on the Service for that Content. You shall not copy, reproduce, distribute, transmit, broadcast, display, sell, license, or otherwise exploit any Content without the prior written consent of KROSS KOMICS or the respective licensors of the Content. You agree not to circumvent, disable or otherwise interfere with security-related features of the Service or features that prevent or restrict use or copying of any Content or enforce limitations on use of the Service or the Content therein.

KROSS KOMICS does not transfer any title, right or interest to or in KROSS KOMICS Website, KROSS KOMICS App and/or Digital Content to you.
Digital Content is licensed to you by KROSS KOMICS; not sold, transferred or assigned to you.

  
4. Terms of Use
Upon your download and/or use of Digital Content (individually and collectively, “Service(s)”), you signify your agreement to the terms of this Agreement and Privacy Policy. If you do not agree, you may not use the Service(s).

In case, the only few Digital contents or Service(s) shall be not intended for anyone under the age of seventeen (15) years old. The use of few our Service(s) by the minor (as defined in the law of your own country) is subject to the consent of their parent or legal representative. You declare that if you are the minor, your Representative(s) have read and agreed with these Terms of Use [or Privacy Policy] before you start to use the few Digital contents or Service(s) offered by KROSS KOMICS. Representatives shall be liable for the acts or omissions of their represented minors.

You must use KROSS KOMICS Website, KROSS KOMICS App and/or Digital Content in compliance with all applicable laws.

  
5. Privacy
Your Privacy is very important to us. We respect your privacy and have established certain policies and procedures relating to the collection and use of your personal information in connection with your use of the Service. Our Privacy Policy is available on KROSS KOMICS Website and/or KROSS KOMICS App and applies to your use of the Service.

  
6. Payment and Refund
Certain features of the Service, require the payment of fees and use virtual “cash” (“COIN”) to purchase a license to view certain Digital Content.
If you elect to purchase COIN, you warrant that (i) you have the legal capacity (if you are a minor, your legal guardian has granted their consent) to purchase COIN and use COIN to get a license to view certain Digital Content (ii) your use of a credit card or other payment service on the Site is authorized, and (iii) all information that you submitted for your transaction is true and accurate.
YOU UNDERSTAND AND AGREE THAT ONCE YOU AUTHORIZE US TO CHARGE YOU THROUGH THE PAYMENT SERVICE YOU CHOOSE FOR A CERTAIN AMOUNT, SUCH AMOUNT SHALL UNDER NO CIRCUMSTANCES BE REFUNDABLE INCLUDING, WITHOUT LIMITATION, UPON TERMINATION OF YOUR ACCOUNT FOR ANY REASON AND/OR THE DISCONTINUATION OF THE SERVICE OTHER THAN ARISING OUT OF OUR GROSS NEGLIGENCE AND/OR WILLFUL MISCONDUCT.
You understand that if such event occurs as any payment transaction, you shall immediately contact to the use of Payment Service Companies where the main contact information is provided on the Site.
  
7. Suspension of Access
We may modify, suspend, or discontinue access to certain Digital Content in the event of a rights issue or other business or legal issue.

  
8. Termination
You have the right to opt out of the Services at any time by removing your Content or by sending a written notification.
Your rights under this Agreement will automatically terminate if you fail to comply with any term of this Agreement. In case of such termination, you must cease all use of KROSS KOMICS Website, KROSS KOMICS App and/or Digital Content, and KROSS KOMICS reserves the right to immediately revoke your access to KROSS KOMICS Website, KROSS KOMICS App and/or Digital Content.

Users, who violate these Terms of Service, tamper with the operation of the program or engage in any conduct that is detrimental or unfair to KROSS KOMICS, the program or any other users (in each case as determined in KROSS KOMICS' sole discretion) are subject to suspension or cancellation of their user account(s) without receiving any benefits.
KROSS KOMICS will terminate a user's access to the Service if, under appropriate circumstances, the user is determined to be a repeat infringer.

KROSS KOMICS reserves the right to decide whether Content violates these Terms of Service for reasons other than copyright infringement, such as, but not limited to, pornography, obscenity, or excessive length. KROSS KOMICS may at any time, without prior notice and in its sole discretion, remove such Content and/or terminate a user's account for submitting such material in violation of these Terms of Service.

  
9. Limitation of Liability
Users agree to be bound by these Terms of Service and by the decisions of KROSS KOMICS, which are final. KROSS KOMICS reserves the right to suspend or cancel user accounts and any benefits should viruses, bugs, unauthorized human intervention or other causes beyond our control affect the administration, security or proper handling of the benefits or KROSS KOMICS otherwise becomes (as determined in its sole discretion) incapable of running the program as planned. In case of bankruptcy, KROSS KOMICS reserves the right to deny all benefits and obligations that we may have.

When permitted by law, KROSS KOMICS will not be responsible for lost profits, revenues, or data, financial losses or indirect, special, consequential, exemplary, or punitive damages.
To the extent not prohibited by law, the total liability of KROSS KOMICS, for any claim under these terms, including any implied warranties, is limited to the amount you paid us to use the Service (or, if we choose, to supply you the Service again).

In all cases, KROSS KOMICS will not be liable for any loss or damage that is not reasonably foreseeable.
In case of any conflict or inconsistency, further agreements between you and KROSS KOMICS supersede these Terms of Service.

  
10. Disclaimer of Warranties
KROSS KOMICS makes no representations or warranties that the service or your access to and use of the service will be uninterrupted or error-free, free of viruses, malicious code, or other harmful components, or otherwise secure. Use of KROSS KOMICS Website, KROSS KOMICS App and/or Digital Content, and any software is at your sole risk. KROSS KOMICS provides the Service(s) as “AS IS” with all faults and without warranty of any kind, and KROSS KOMICS and its licensors disclaim all warranties, express, implied, or statutory, including but not limited to, implied warranties or conditions of merchantability, fitness for a particular purpose, accuracy, quiet enjoyment, satisfactory quality, non-infringement of third-party rights, and their equivalents under the laws of any jurisdiction.

KROSS KOMICS is not responsible for any damage to your mobile, tablet, laptop or desktop device, computer system, other hardware, or software, or for any loss of or damage to data that may result from your use of the service.

  
11. Indemnification
You agree to indemnify, defend, and hold harmless KROSS KOMICS and its affiliates against any losses, liabilities, claims, causes of action, and expenses (including, but not limited to, reasonable attorney’s fees and costs of investigation, whether before or after assertion of a formal claim, and reasonable litigation expenses) arising out of or relating to your use of the Service, your User Postings, your violation of this Agreement or your violation of any applicable law or regulation.

  
12. Governing Law; Disputes
The laws of the republic of India, without regard to principles of conflict of laws, will govern this Agreement and any dispute of any sort that might arise between you and KROSS KOMICS. You agree that any cause of action that may arise under this Agreement shall be commenced and be heard in the appropriate court in the republic of India. You agree to submit to the personal and exclusive jurisdiction of the courts located within the republic of India.

You can review the most current version of the Terms of Use at any time at this page.
We may amend any of the terms of Use in our sole discretion by posting the revised terms on KROSS KOMICS Website and/or KROSS KOMICS App. Modifications and revisions will take effect 7 days after they have been posted.

Your continued use of KROSS KOMICS Website, KROSS KOMICS App and/or Digital Content after the effective date of any such amendment constitutes your agreement to be bound by such amendment.
The Agreement will note the effective date of each version.
